The P.J. Hairston story is getting uglier

North Carolina’s P.J. Hairston was arrested and charged with possession of marijuana Wednesday night after a routine traffic stop. Now, the story has a new twist. According to ABC 11 in North Carolina, Durham police confirmed a gun was found on the ground outside Hairston’s vehicle. Forensics are being done this morning.
Hairston, who turned down the NBA to return to Chapel Hill, is North Carolina’s leading scorer from a year ago and star player heading into the 2013-14 season.
North Carolina will host your University of Kentucky Wildcats on Dec. 14.

18.) If someone in the car is a felon/probation the presence of a gun could be an issue. Also, the presence of guns + drugs usually counts as an enhancement for sentencing and charging purposes.

Instead of us (hypocritically) making fun of this kids culture with guns, how bout we focus on the fact that distinguishes him from an average, legal gun-toting American. The fact is, no one who owns a gun legally throws it out a window. There can be multiple reasons for this, but none of them make him look good. I will say the same thing I would say about this situation if it were Julius Randle…he should either be gone, or serve some serious suspension. I realize that kicking a kid out of college, might not be what’s best for his life, and maybe he deserves a second chance. But a slap on the wrist should not cover this.

Maybe the kid has a permit and all the other proper paperwork (which I think is ridiculous to begin with, but that’s another story) to carry this legally. I doubt it, but let’s not crucify the kid yet. Weed should be legal anyway too, but that’s also another argument for another time and place.

Well presumably you can read, so discern it for yourself. I never said that I don’t see anything wrong with the situation. By the letter of the law he certainly at least broke one (marijuana possession). What I said was that I don’t think this is a law that should be on the books in the first place. I also said that there may be a perfectly legal explanation as to why he had a gun and that people should wait to make a judgment on that. Was all that really so hard for you to understand?

True, it does look shady and if it is in fact his gun then he will probably be in big trouble. I generally dislike UNC, but don’t like the court of public opinion here bashing the kid. If the gun isn’t his and belongs to one of his passengers, the worst thing he’s guilty of is marijuana possession and needing to pick better friends, which are hardly the worst offenses in the world.

Wow….. the “Cops” trifecta… weed, gun, AND a suspended license. He may have to actually attend a class at UNC before this is over!
Some people need to do a little investigating before spouting off about marijuana users. There are currently 18 states, plus our nation’s capital, where it is legal to use marijuana for medical purposes. There are also 2 states(Washington and Colorado) that have legalized marijuana for recreational use, and more w/ legislature in process. In addition to only being illegal because of concerns over taxes and other industries, there have been zero studies done to back up the claims of ‘addiction’ or that it is a ‘gateway’ drug. No one forces you to drink a beer, but it is every citizen’s(over the age of 21) right to do so. People like Mojo would be VERY surprised to learn that the majority of Americans see nothing wrong with it; including thousands of extremely successful professionals(doctors, lawyers, nurses, judges, etc.). It’s not for everyone, but neither is alcohol. Be careful labeling people…statistically speaking, your boss probably partakes.
Now that I’m off my soapbox…nothing says ‘not guilty’ like running from the cops(or tossing a weapon).
There is a clear distinction most are missing out on in the racist/gun ownership debate on here. The prevailing evidence in most cases involving athletes – regardless of race – is that they carry/own guns illegally. If they have a permit to carry, then more power to them. What the Charlton Heston and Ted Nugents of the world have that so many of these athletes don’t have is the common sense to get that permit.
If Ted Nugent gets arrested for playing “Stranglehold” too loud from his front porch, he’s not gonna get in trouble with the law because he has the paperwork to back it up.

Per UNC site, he had 1.5 ounces of weed which is over the .5 felony limit. They said they read it on police report. Down in rough hood in Durham and get stopped at traffic check and somebody throws a gun out. Didn’t find it until later I think. I’m not sure roy can ahshucks his way around this one…

As a CCDW instructor, I can tell you that there is a problem. If the gun is linked to him after forensics, then it will be considered concealed because he threw it out to hide it from the officer. Even if he has the permit to carry, it is null-in-void due to the drug charge. You cannot even carry in a bar if the majority of the sales are from alcohol…or a government building (ie school, court house, etc).
If his prints are on the gun the other question is if it is in his name. If his prints are on there and the serial number is filed off (as it often is in these situations), then there are more issues.
Whether or not you agree with weed laws…whether you run your mouth when you do not know CCDW laws…this kid could be in serious trouble.

As far as I know, it is not illegal to carry a gun in NC. But if you try to hide it (by throwing it from the vehicle) that is considered concealment and you will be in deep. As others have said, no one tosses a legal gun, so you can bet whoever was carrying it was breaking the law. As far as the weed goes, 1.5 OZ is enough for a distribution charge in most areas, so that will be a felony, although it isn’t uncommon for a first offense to get knocked down to simple possession, a misdemeanor. College students are adults, so I have no issue with them carrying weapons in general. They have the same rights as anyone. Bottom line, if it’s his gun, he will catch a felony weapons charge along with evidence tampering, and the dug charge will probably be knocked to a misdemeanor. I don’t see any way he stays on the team. If the gun isn’t his, probably just the moving violation and a misdemeanor drug charge, meaning he will be suspended from the team I’d imagine.

Who cares about either charges? Think about it. You are 8 times more likely to be killed by a police officer than a terrorist. Who is the protect us from “our protectors?” Of course, we have the right to carry a gun. “An armed society is a polite society.” Second, the war on drugs is a major money maker for “the system.” Millions of people are employed DUE TO the war on drugs. It’s a scam. And yet, alcohol is legal. The drug war is like any other war on you-fill-in-the-blank, it’s an excuse for expanded gov’t power.
Let this young man go, along with millions of others who’ve been arrested and imprisoned for non violent drug “crimes.” Prosecute them if they kill or harm somebody, but otherwise, live and let live.

Also I’d say I have a higher chance of being killed by almost anything other than a terrorist in the United States.
