The NCAA has ruled and Enes will not be allowed to play college basketball at Kentucky. Here is the release:

INDIANAPOLIS —University of Kentucky men’s basketball student-athlete Enes Kanter has been ruled permanently ineligible for receiving impermissible compensation from a professional team.

The NCAA Student-Athlete Reinstatement Committee has upheld the NCAA staff decision that Kanter received $33,033 above his actual and necessary expenses for one year while playing for a club basketball team in Turkey.

The reinstatement committee is the final appeal opportunity. The independent committee is composed of representatives from NCAA member colleges, universities and athletic conferences. It can reduce or remove the conditions but cannot increase the conditions imposed by the staff.

As a result of the ruling, Kanter will not be allowed to compete, practice or travel with the team as a player, but is able to receive financial aid to continue his education at Kentucky. The university has indicated it plans to designate Kanter as an undergraduate student-assistant coach. In this capacity, Kanter could perform limited coaching duties with the team.

Actual and necessary expenses are defined by NCAA rules and generally relate to a player’s expenses directly necessary for practice and competition on a team. Some examples include meals and lodging directly tied to practice or competition, coaching, medical insurance and transportation tied to practice or competition.

Kanter played three seasons with the Turkish sport club Fenerbahce from 2006-07 to 2008-09. Although he competed primarily for the club’s under-18 junior team, he did compete on the club’s senior team in 2008-09. According to facts agreed to by the university and the NCAA Eligibility Center, Kanter received $33,033 more than his actual expenses for the 2008-09 season.

Although a recent NCAA rule change allows prospective student-athletes to compete on teams with professionals while maintaining their amateur status before college enrollment, the membership maintained the longstanding rule that receipt of money above actual and necessary expenses from a professional team is a violation and defines the individual as a professional under NCAA legislation. That was the case here.

Kanter was initially ruled ineligible Nov. 11 by the NCAA reinstatement staff. Before reaching its decision, the reinstatement staff considered a number of factors, including: the nature and seriousness of the violation; any impermissible benefits received; the student-athlete’s level of responsibility; any mitigating factors presented by the university; applicable NCAA guidelines; and any relevant case precedent.

The original staff decision was upheld by the reinstatement committee on Dec 2.

On Dec. 8, the university asked for and was granted reconsideration of its case based upon new information. This is in keeping with NCAA policy allowing schools a second opportunity to state their case should new information become available.

The new information did not change the original statement of facts that had been agreed to by the university and the NCAA prior to the start of the reinstatement process.

After considering the new information, the reinstatement staff once again ruled Kanter permanently ineligible Dec 10. In response to the staff decision, the university chose to appeal a second time to the reinstatement committee. Kentucky’s appeal was heard on Jan. 6 and the school was informed on Jan. 7 of the committee’s decision.

“While unfortunate for Enes and the University of Kentucky, the final decision of the reinstatement committee is completely compatible with the collegiate model of sports our members have developed, since he received a significant amount of money, above his actual expenses from a professional team prior to coming to college,” said Kevin Lennon, NCAA vice president of academic and membership affairs.

    Remember folks, the NIT used to be the governing body that ruled college athletics. Then everyone jumped ship to go with the NCAA. I see a mutiny coming sometime soon, as there’s really no one other than the NCAA, that’s currently thinking the NCAA is doing an acceptable job.

    19) No, this is a per se rule. Anything above actual and necessary from a professional basketball team makes you a professional basketball player. No exceptions. No mitigation. It’s a bright line no one can cross.

    Apparently knowledge and intent and actions taken to protect oneself don’t mean a damn thing. That’s the injustice. This kid is a victim. First by Turkish club team. Now by the NCAA.

    The NCAA had better hope that nothing ever comes out proving that Cam Newton or his father actually received money. Either that, or they’d better do a bang-up job of hiding it. Because if Auburn wins the National Championship on Monday night and we find out 6 months down the road that he or his father RECEIVED money (since the NCAA is going to hide behind that now), they’d better be prepared to vacate that National Title on the spot.

    I kinda felt this was coming, but still, I’m so shocked/saddened/enraged right now that I think I’m numb. I understand that a lawsuit might not have any merit, but God help me, if I had the chance to put the NCAA on the witness stand, under oath, so they would have to explain themselves…well, that’s an opportunity you just can’t pass up. This crap can’t be allowed to continue any longer.

    It’s over…. In my opinion, the NCAA got this one wrong. I see what they’re saying about the payments but I feel the Appeals committee missed the biggest point….INTENT! Obviously, Enes and his family has tried to keep his amateur status and that point they seem to overlook. This sucks!!!

    Sucks. But I’m glad it’s over. Seems to me they could have saved a lot of suffering and not changed any rules about foreign players. Not to mention this took half the damn season. It’s like they wanted him to suffer and anyone else involved. That’s what pisses me right off! Sure doesnt look like they want foreign players here to me.

    Its time to move on from this BS but no one should forget. A time will surely come when the NCAA will regret the way they do business.

    They don’t give a rats rear end about the kids. Never have. The Memphis decision is totally ridiculous, and they showed their true colors when they told Memphis, they were going to increase the penalties, if they appealed the decision. This is similar, in that, what benefit did Kanter receive? if the money was paid back, when all along they were trying to do the right thing and had no guidance. Maybe, they should have recommended the money be paid to the NCAA, instead of paying back to Turkey, but then it wouldn’t been enough for NCAA taste, but it was enough to rule this way.
    I keep hearing that a law suit would not be successful, but it seems to me they have to show some consistency, and there is not any.

    But in all seriousness: The NCAA is a fraud and a joke. A lot of people talk about clamping down on the BCS, and I agree somebody needs to, but the focus needs to be on the entire NCAA. If congress can take time out of their day to see if Barry Bonds really stuck a needle in his butt then they can take time and look at the activity of this crooked organization. The NCAA needs a watch dog group and fast. This is absurd beyond words.

    This is a dark day in the bluegrass today. To say the NCAA got it wrong is just an understatment. All this kid wanted to do was play collegent basketball, and a bunch of over zealous adults took that opportunity away. To think that someone who tried their very best to be on the up and up to have it snatched away while you have kids getting all kinds of unauthorized benefits is flat out a crime. The NCAA is so inconsistant that it should be under federal investigation themselves. No longer will I trust the NCAA or anything it represents, because of this ruling they are no longer an organization to be trusted. Be it duke uw osu ku and a hand full of other colleges this is just a travisty to everything that is honest. I sinerely hope that Enes will go above this and make the NBA his.
    On the other side of this coin, his team mates should feel that every game should be in his honor and hopefully TJ, and Jorts dominate the paint as I know they do their very best.
    THIS IS TRUELY A SHAME, AND THE SHAME SHOULD FALL DIRECTLY IN THE LAP OF THAT UNETHICAL INSTITUTION……..GO CATS!!!!!!!!

    Some of you people make me so proud to be a Kentucky Fan. Way to make our fanbase look like idiots? I can see the headlines now: “Letter from Joe Schmoe in Bumfuk, KY changes NCAA’s mind. Kanter will play.” Get over it. I think that UK went out of their way to get this kid the chance to play. It didn’t happen. I feel bad for Enes as he could still be playing, but not at DUKE, but back in Turkey, then go to the NBA at the right age. I hope that Enes appreciates it the efforts put forth, and as has been stated, he will always be a Cat.

    Look, here it is in simple english… If you hate our rivals, why give them idiotic type reactions like this to fuel there fire?     I have $100 to donate to the legal fund. They think we raised a lot for Haiti. Civil rights doesn’t matter here. They have effectively demonstrated bias and they are effecting Enes’ future earnings (draft position). It could also be plausibly shown that they are effecting our states economy which hurts us all. Class action anyone? Or take the route of starting a fund to sue them for all college athletes……. I mean the plantation economics model they use should be considered a violation of civil right. Room and board for the hundreds of millions they make. And it doesn’t matter if a law suit works or not. We can hurt them were it counts…… their wallets. Maybe we would not get a decision but they would have to shell out for the defense.

    108) Josh Selby took money from a pro manager / agent. The difference is growing up in Turkey you don’t know those rules. In the USA every kid on every playground, AAU, High School team knows if you accept money from an agent you jeapordize your amateur status in the NCAA. Not to mention him driving a $40K Mercedes. Selby knew it was against rules so did Carmelo’s manager who gave it to him. Enes took steps by putting the difference of the money he was paid in escrow that they didn’t use for school. He turned down a $2 million contract. I can live with the decision. Fine Cam didn’t know his dad was pimping him, which is stupid too. Yeah the Ohio State guys were given the option for the bowl suspension because they didn’t have enough info that it was wrong, despite the fact O state has 6 compliance officers. Jeremy Jarmon didn’t get that consideration, nope. Hit the road Jack. Those decisions are about money. Not the NCAA integrity which they have 0 of. In my opinion its time the power conferences leave the NCAA and start their own league and have playoffs and the whole deal. F the NCAA and their inconsistent bs.

    Mr. Emmert,
    I’m appalled at the decision the NCAA(National Crooked Athletic Association) handed down on the Enes Kanter eligibility. You have let other athletes and schools get by with somewhat questionable student-athletes yet you punish Enes and the University of Kentucky. I bet if some great deal of money was to be had for the NCAA, the decision would have been different. I guess he’s not Cam Newton, Josh Selby, Dee Bost, Pryor(and the other OSU players) so you destroy this young man’s hopes of playing college ball and for the University of Kentucky. I guess if he went to Washington as first indicated, he would be allowed to play.
    I guess UK doesn’t have the pocketbook like DUKE, NORTH CAROLINA or OSU. You can say it’s not about money for the NCAA but the decision recently handed down sure indicate that money does the talking and BS does the walking.
    I’m a big watcher of college basketball and I have my favorite but do follow others. After this truly wrongful and biased ruling, my interest in the NCAA and college basketball has been tainted.
    I’m waiting for the time when the fans and the universities have the NCAA brought down for one sided rulings they have conveniently pulled out of their behinds and then make up excuses and half-baked reasons for their rulings.
    So I say to you Sir, the NCAA organization is a joke. Has been and always will be!! The credibility of the NCAA organization is a joke. I would be hard for the Kanter’s to follow the rules when you guys change them to suit your needs. All I can say, if your organization doesn’t want foreign athletes to play college sports, why don’t you man up and tell the world you don’t want them.
    Your motto should be”show me the money”!!!
    Of course this is my personal opinion and the opinion of others.
